Questions are being raised as to whether Elevate Cannabis, Westchester’s first legal recreational cannabis shop, is legally allowed to operate four months after it first opened,

According to Tuesday night’s city Planning Board work session, there are questions about whether the property has a certificate of occupancy and whether it would need zoning variances for additional parking spots or its proximity to a house of worship.

Board members said the property did receive proper authorization from New York last December through the state’s Conditional Adult Use Retail Dispensary program. The board also acknowledged this would be the first time it will see this application.

It’s unclear how the business was allowed to open and operate for so long if it lacked the proper permits.

The Planning Board will hold a public meeting Wednesday night that could determine the business’ future.

The meeting will be held at the City Council chambers in Mount Vernon City Hall at 6:30 p.m.
